Terms & Conditions

1. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms or your use of the Platform.

2. Eligibility

You may only register and use the Platform if you:

• Hold a valid Australian Business Number (ABN) registered with the Australian Business Register (ABR).
• Are authorised to conduct business under that ABN.
• Are at least 18 years of age.

We verify your ABN against the ABR at registration. Providing a false or inactive ABN is a material breach of these Terms and will result in immediate account suspension.

3. Platform Role

TradiePool is a marketplace that connects job posters with potential bidders. We are not a party to any agreement entered into between a job poster and a bidder. We do not:

• Employ, endorse, or guarantee any tradesperson listed on the Platform.
• Supervise, direct, or warrant the quality, timeliness, or legality of any work performed.
• Handle payments between users — all payment arrangements are agreed directly between poster and bidder.

The relationship between a job poster and the awarded bidder is a contract between those parties only. TradiePool has no liability for that contract.

4. Job Poster Obligations

If you post a job on the Platform you must:

• Provide an accurate, honest description of the work required.
• Ensure the job is for legitimate trade work you have the right to commission.
• Not post prohibited content (see Section 8).
• Respond to bids in good faith and in a timely manner.
• Not cancel awarded jobs without reasonable cause.
• Honour any agreed arrangement with an awarded bidder.

5. Bidder Obligations

If you place a bid on the Platform you must:

• Hold the relevant trade licences and insurance required by law for the work you bid on.
• Submit honest, accurate bids — including realistic price, availability, and any relevant conditions.
• Be genuinely available to perform the work if awarded.
• Honour awarded bids — withdrawing after award without reasonable cause is a breach of these Terms.

6. Credit System

• 1 credit = 1 job publish. Publishing a job from DRAFT to OPEN costs 1 credit.
• 3 free credits are granted on account creation.
• Additional credits may be purchased through the Platform’s in-app billing.
• Credits are non-refundable once purchased, except as required by the Australian Consumer Law (see Section 14).
• Credits have no expiry date.
• Credits are non-transferable and have no cash value.

7. Prohibited Content

You must not post, submit, or communicate through the Platform:

Violation of this section may result in immediate account suspension and referral to relevant authorities. For full details see our Acceptable Use Policy.

8. Dispute Resolution

Users are responsible for resolving their own disputes. TradiePool is not obligated to intervene in any dispute between a poster and a bidder.

Where a dispute is escalated to us, we may at our sole discretion review the matter and attempt informal mediation. Our decision on any mediation outcome is not binding on either party.

If informal resolution fails, parties may seek resolution through NSW Fair Trading, the appropriate trade licensing authority, or the courts of New South Wales.

9. Liability

To the maximum extent permitted by law, TradiePool is not liable for:

• The quality, safety, or legality of any work performed by a bidder.
• Any payment dispute between a poster and a bidder.
• Any loss, damage, or injury arising from work arranged through the Platform.

Our total liability to you for any claim is limited to the amount you paid to TradiePool in the 12 months preceding the claim.

Nothing in these Terms limits or excludes any liability that cannot be excluded by law, including under the Australian Consumer Law.

10. Account Termination

TradiePool may suspend or terminate your account, with or without notice, if you breach these Terms, provide false information, engage in conduct harmful to other users or the Platform, or fail to pay any amounts owing.

On termination, unused credits are forfeited (except where required otherwise by the Australian Consumer Law) and you lose access to the Platform immediately. Your obligation to honour any pre-termination awarded bid remains.

You may close your account at any time by contacting support. We will retain your data in accordance with our Privacy Policy.

11. Intellectual Property

All intellectual property in the Platform remains our property. You may not copy, reproduce, or distribute any part of the Platform without our written consent.

You retain ownership of the content you post. By posting content, you grant TradiePool a non-exclusive, worldwide, royalty-free licence to use that content to operate and improve the Platform.

12. Privacy

Your personal information is collected and handled in accordance with our Privacy Policy, which forms part of these Terms. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

13. Changes to These Terms

For material changes we will provide at least 14 days’ notice by email to your registered address and/or a prominent notice on the Platform. Continued use of the Platform after the notice period constitutes acceptance of the revised Terms.

14. Australian Consumer Law

These Terms do not exclude, restrict, or modify any right or remedy you have under the Competition and Consumer Act 2010 (Cth) Schedule 2 (Australian Consumer Law) or any other applicable Australian law that cannot be excluded. Nothing in these Terms is intended to contract out of any statutory guarantee under the ACL.
